Terms of use

1. Provider and scope

CloudHamSuite (at cloudhamsuite.de) is offered by:

These terms apply to the use of CloudHamSuite, including the station, logbook, map and the offers under “Extras”. By registering, you accept them. To do so, you tick the box in the registration form by which you accept these terms. You can create an account from the age of 16; under 16 only with the consent of your parents or other legal guardians.

2. Service

CloudHamSuite is free of charge. The station runs in your browser and controls your rig via USB; the server stores the account, rig profiles and logbook and provides the map. The server never switches a rig to transmit.

We strive for reliable operation but do not promise any particular availability. Maintenance, faults or updates can interrupt the service temporarily. Features can change, be dropped or be added. We can also discontinue the service entirely; we will announce this by email at least four weeks in advance so that you can export your logbook.

We back up the data regularly but cannot rule out a loss. Please export your logbook regularly as ADIF.

3. Your account

• Give truthful information when registering and use only your own callsign in rig profiles.
• Keep your password, recovery codes and two-factor app secret. If you notice misuse, change the password and inform us.
• You can delete your account yourself at any time under “Settings” › “Account”. This permanently removes the logbook, rig profiles, service and export profiles and the Funklehrer progress.
• It is not permitted to disrupt or attack the service, to circumvent limits, to query it automatically to an extent that goes beyond normal use, or to generate false reception reports.
• If you violate these terms or radio law, we can block or delete your account temporarily or permanently. In doing so, we take your legitimate interests into account, usually issue a warning first and tell you the reason by email. We block without a warning only in the case of serious violations or when there is a danger to the service, other users or radio traffic.

4. Amateur radio and transmitting

You may transmit with CloudHamSuite only as a radio amateur with a valid licence and only within the scope of your licence. You alone, as the licence holder, are responsible for every transmission via your rig, in particular for frequency, band, transmit power, antenna and compliance with the German Amateur Radio Ordinance (Amateurfunkverordnung) or the regulations of your country.

For German callsigns, CloudHamSuite derives the licence class from the prefix; this is not proof of a licence. Where you state your licence class yourself, the information must be correct. Band limits, the power limit and the PTT check are aids and do not replace your own control. Rigs that are not expressly named as tested are controlled by CloudHamSuite via Hamlib without having been tested.

Stay at the rig while transmitting and switch it to receive by hand immediately in the event of a disturbance or malfunction. We are not responsible for transmissions by users; our own liability is governed by section 8.

5. Third-party data and services

The map and other displays show third-party data, for example from PSKReporter, Reverse Beacon Network, POTA, SOTA, wspr.live and space weather services. We give no guarantee for its accuracy, completeness and availability. The terms of the respective providers also apply to this data.

Reception reports of your station (callsign, locator, stations heard, frequency) are transmitted to PSKReporter or WSPRnet as part of the service and are displayed publicly there.

We send contacts to log services such as eQSL or Club Log only when you trigger it, and only with the credentials you have stored yourself. Your account with these services is governed by their terms.

For its AI assistant, the Funklehrer under “Extras” uses an external AI service to which our server forwards your question. AI answers can be wrong; the official exam documents are authoritative. The number of AI requests per account and day is limited (currently 50). The games under “Extras” are an additional offer with no entitlement to permanent availability.

6. Your content

The logbook, profiles and other content that you create or upload remain yours. You grant us only the rights needed for operation: storing, backing up, showing to you, exporting and transmitting to log services at your request. These rights end when your account is deleted, except insofar as data still remains briefly in backups. Upload only content you are entitled to.

Rights under open-source licences, such as the LGPL for Hamlib, remain unaffected; details are under Licences.

7. Advertising

CloudHamSuite is meant to remain free of charge and in future to be financed by advertising delivered by an advertising network. There is currently no advertising. Before advertising is introduced, we will inform you and adapt the privacy policy.

8. Liability

As we offer CloudHamSuite free of charge, we are liable only for intent and gross negligence. In addition, we are liable without limitation for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and if we have fraudulently concealed a defect. Otherwise, liability is excluded. This also applies to our vicarious agents.

9. Changes to these terms

We can change these terms if the legal situation, the service or the technology changes. We will announce changes by email and in the application at least six weeks before they take effect. Until then, you can object or delete your account. If you do not object and continue to use the service after the changes have taken effect, the new terms apply; we will expressly point this out in the announcement. If you object, either party can terminate the contract of use.

10. Privacy

How we process personal data is set out in the privacy policy.

11. Final provisions

German law applies. If you are a consumer with your habitual residence in another country, the mandatory consumer protection provisions of that country remain unaffected.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
